1. These General Terms and Conditions govern the relations between EasyRentBulgaria Ltd, UIC 202163172, hereinafter referred to as "EasyRent", and Renters arising on the basis of a car rental contract or other items offered by EasyRent.
2. Correspondence with Easy Rent is carried out at the address: Nessebar 8230, Sunny Beach resort, Hotel Karlovo, ground floor, telephone +359 (0) 700 50 700; e-mail address: [email protected] or by any other means specified on the EasyRent website: https://easyrentbulgaria.bg/.
3. Wherever in these Terms and Conditions the following words and expressions, when beginning with a capital letter, whether in the plural or in the singular, shall have the meanings set out in this clause:
А) "Terms and Conditions" – these Terms and Conditions for the conclusion of rental contracts for a vehicle (car) or other items offered by EasyRent.
B) "Individual Contract" means a contract for the rental of the vehicle concluded between EasyRent and the Renter. These Terms and Conditions are an integral part of each individual contract. In the event of any conflict between the Individual Contract and the General Terms and Conditions, the Individual Contract shall prevail.
C) "Renter" – an individual who wishes to use and/or request and/or enter into a rental contract for a vehicle or other items offered by EasyRent.
D) "Driver" – an individual who will drive the rented vehicle. Where the driver is a person other than the Renter, the relevant details of the driver shall be recorded in the individual rental contract. Only one additional driver may be recorded in the contract. All obligations of the Renter under the General Terms and Conditions and the Individual Contract shall also be deemed to be obligations of the Driver.
E) "International Driving Licence" – a driving licence certifying the right to drive a vehicle which, by virtue of international treaties, has entered into force for the Republic of Bulgaria and entitles the Renter to drive the vehicle in the territory of the country and in the territory of the relevant country in which the use of the hired vehicle is permitted under the General Terms and Conditions.
F) "Vehicle Classes" – categorisation of individual vehicles according to their technical characteristics, class and standards. The individual car classes are economy, medium, large, station wagon, premium, minivan, luxury, special and SUV, with the classification of individual makes and models of cars to the relevant class being set out on the EasyRent website or partner platform.
G) "Similar Class Vehicle" means a vehicle in the same class, of the same or similar size, with the same number of doors and seats.
H) "Rental Price" means the price for the rental of the relevant vehicle for a period of 24 hours, which is stated in the EasyRent Price List or announced on the EasyRent website or stated in the rental contract;
I) "Full Coverage Fee" means the value, determined according to the class of vehicle as set out in the EasyRent Price List, by payment of which the Renter benefits from the additional services provided for in these Terms and Conditions.
J) Price List means a list of the additional services/extras provided by EasyRent, indicating the prices/fees for them.
4. The Renter shall possess and present to EasyRent a driving license for the relevant category of motor vehicle, valid for a period of not less than one month after the end of the rental period of the vehicle and a functioning credit card – with a free (unused) limit not less than the amount of the deposit, valid for not earlier than six months after the end of the rental period. Drivers of non-EU nationality must present an international driving licence.
5. The Renter is obliged to present identification documents (ID card or passport) with a minimum validity of not less than one month after the end of the rental period.
6. The minimum age for renting a vehicle at no extra charge is 21 years for economy, mid-size, large, station wagon and minivan vehicles and 30 years for luxury, premium, specialty and SUVs.
7. Renters between the ages of 18 and 21 or with less than 3 years of driving experience pay extra:
(a) a Young Driver Fee of EUR 7.00 per rental day;
(b) a Full Coverage Fee determined according to the type of vehicle;
(c) a triple deposit, determined according to the type of vehicle.
8. Renter must have at least 6 months of driving experience for Economy, Midsize, Large, Station Wagon and Minivan classes and 5 years for Luxury, Premium, Specialty and SUV classes.
9. EasyRent reserves the right to refuse the reservation or delivery of the vehicle in the event that any of the documents submitted by the Renter do not meet the requirements of the Terms and Conditions or are damaged/invalid.
10. The Renter can book a vehicle through an online platform on the EasyRent website; through an online platform for rent-a-car services, on which EasyRent offers its services (partners), by request by phone or at the company's office. In the case of an online reservation, the same will be deemed confirmed upon receipt of an email message of confirmed payment or upon the occurrence of the conditions for confirmation, according to the policy of the respective platform.
11. In case of booking at EasyRent's office or upon receipt of the vehicle in case of online booking, the Renter shall enter into an individual rental contract, which shall specify the terms and conditions of the rental of the vehicle – type of vehicle, registration number, rental period, rental price, condition of the vehicle and other matters. The General Terms and Conditions are an integral part of the individual contract.
12. A confirmed and paid reservation may be changed/cancelled free of charge up to 48 hours before the requested pick-up time. In case the reservation is made via the online platform of the EasyRent website, the reservation fee will be refunded to the Renter within 20 working days. In case of cancellation or cancellation between the 48th and 24th hour before the requested pick-up time for a reservation made through the online platform of the EasyRent website, the prepaid fee will be refunded to the Renter's wallet on the website and can be used for a subsequent reservation without time limit. No interest or any other compensation shall be payable by EasyRent for the period the amount is in the Renter's wallet.
13. In the event that the booking is made through another online rent-a-car service platform on which EasyRent offers its services, the cancellation or cancellation of the booking, respectively the refund of the booking fee shall be made in accordance with the General Terms and Conditions/policy of the respective platform and not by EasyRent.
14. In the event of refusal or cancellation of a booking by the Renter outside the time limit under the preceding clauses, the booking fee is non-refundable.
15. EasyRent reserves the right to refuse a confirmed booking in the event of inability to provide the requested vehicle or another of a similar class, and the amount paid by the Renter will be fully refunded. In this case, EasyRent shall not owe any compensation to the Renter.
16. Except as provided for in these Terms and Conditions, EasyRent reserves the right to refuse to provide a vehicle in the event of improper and/or inadequate conduct by the Renter or where there is reasonable cause to believe that the Renter will be unable to perform the contract. In this case, the booking fee shall be refunded to the Renter, unless otherwise stipulated in the General Terms and Conditions.
17. The minimum rental period is 24 hours. The vehicle may be made available for use for a shorter period only with the prior approval of EasyRent, in which case the Renter will be liable for a rental charge equal to the price for the minimum period. The same rule will apply when an extension of the rental period for only a few hours is requested.
18. An extension of the rental period of the vehicle can be made, via the online platform of the company's website or at an EasyRent office, no later than one day before the expiry of the rental period according to the individual contract. Renewal can be done by indicating this on the individual contract, by signing an annex or by concluding a new contract. The price for the new rental period depends on the period of the extension according to the current Price List on the day of payment, and a Full Coverage fee must be charged.
19. When the extension of the rental period includes the use of the vehicle in another country, a fee of EUR 20.00 will be charged for extending the driving authorisation abroad by up to 7 days. If the rental period is extended by more than 7 days, the Renter shall also pay all fees and charges for the reissue of the foreign driving authorisation and a new one-off passage fee in accordance with the Price List.
20. In the event that EasyRent agrees to extend the rental period, the Renter shall pay the new rental price and any additional fees on the same day. The deposit cannot be used to cover the rental price for the extended period, as the deposit must be paid in full throughout the term of the rental agreement. Once payment has been made, the necessary documents shall be left available at the relevant office. The Renter is required to visit the office and obtain/sign the relevant documents. EasyRent is not responsible for the consequences in case the Tenant has not collected the new documents.
21. EasyRent reserves the right to refuse the extension of the rental period, in which case the Renter must return the vehicle in accordance with the contract and the Terms and Conditions.
22. The vehicle shall be handed over in perfect technical condition, together with the equipment provided for by law or which has been additionally paid for by the Renter. The condition of the vehicle and the relevant equipment shall be ascertained/described in the individual contract upon receipt in the mandatory presence of the Renter. By signing the contract the Renter also agrees to have marked in his presence any damage present at the time of receipt of the vehicle.
23. The offices of EasyRent at Sofia Airport, Varna Airport and Burgas Airport are open 24 hours a day and the vehicles can be collected/returned at these offices at any time without any additional charge and in the event that the vehicle is returned to the same office from which it was collected.
24. The opening hours of other EasyRent offices are stated on the company's website and on site at the respective offices. Vehicles can be collected/returned within the designated opening hours for these offices. If the Renter has requested collection or return of the vehicle outside office hours, he/she will be charged an additional fee of EUR 20.00.
25. EasyRent does not have offices outside the territory of the country and does not use offices of other companies providing the same services.
26. EasyRent reserves the right to provide a different make and model of car than the one originally reserved, of a similar class. In the event that the reserved vehicle is not available at the time of collection and no other similar vehicle is available, EasyRent may offer the Renter a vehicle of a higher class. In the event that the Renter does not agree to the replacement of the vehicle in accordance with the preceding sentences without being asked to pay extra for the difference in class, the prepaid amount shall not be refunded.
27. If the Full Coverage Fee has been paid with the rental of the vehicle, EasyRent may provide a replacement vehicle in the event of damage to the vehicle due to a technical defect or wear and tear of a relevant part of the vehicle. The replacement is carried out at the nearest company office. If the vehicle cannot be driven on its own, the replacement shall be carried out at the place where the defective vehicle is located and the replacement costs shall be borne by EasyRent. Where the damage is the result of the Renter's acts or omissions, the Renter shall be liable to pay all costs of replacement and repair of the vehicle.
28. The reservation fee paid is non-refundable and the car concerned is released from reservation:
А) when the Renter fails to appear at the specified pick-up location within one hour after the requested pick-up time, without prior notice to EasyRent or without indicating the flight number on which he/she arrives;
B) where the Renter has not cancelled the booking within the relevant time limits in accordance with the General Terms and Conditions;
C) where the Renter fails to provide any of the documents required under the General Terms and Conditions or any of them are damaged or invalid;
D) in the event that the Renter refuses to pay the rental price and/or the deposit for the vehicle and/or any additional services requested at the time of signing the contract or within the relevant time limit in accordance with the General Conditions;
E) in the event that the Renter does not have a valid credit card in his/her name with a sufficiently available (unused) credit limit to allow payment of the rental price and/or deposit;
F) in other cases provided for in the General Terms and Conditions.
29. In case of returning the vehicle earlier than the term specified in the contract at the Renter's request, EasyRent shall not refund the amount for the remainder of the rental term.
30. In the event that the Renter is provided with tickets and/or passes for access to airport car parks, these should only be used to exit the vehicle from the car park upon collection. It is forbidden to stay in the car parks for longer than the time necessary for the vehicle to leave. In the event that the Renter fails to comply with this obligation and EasyRent is required to pay fees or charges for use of the parking facilities beyond the time allowed for the above purposes, the Renter shall indemnify EasyRent for the full amount paid.
31. The vehicle must be returned to the same EasyRent office where it was picked-up. Its return to another office is possible upon request by the Renter, at the latest 24 hours before the final date of return of the vehicle, only after approval by EasyRent and upon payment of an additional one-way rental fee according to the Destination Price List. EasyRent reserves the right to refuse the return of the vehicle to any office other than the one where it was picked-up.
32. In the event that the vehicle is to be returned to a parking lot, the vehicle must be parked only in spaces designated for EasyRent's use or designated by the appropriate EasyRent employee.
33. The Renter must return the vehicle in the same condition and equipment in which it was delivered. If any discrepancies are found, the Renter shall indemnify EasyRent for any damage caused to the vehicle. The Renter's refusal to sign a report on the identification of the discrepancies upon return of the vehicle shall be certified by the signature of one witness. In this case, the findings in the report shall be binding on the Renter. The same consequences shall apply where the is not present or has refused to be present when the vehicle is taken back, unless there are good reasons for this.
34. The Renter shall return the vehicle with the same amount of fuel as he/she received it with. In the event that the vehicle is returned with less fuel, the Renter shall pay a service charge of EUR 20.00 and pay for the missing fuel at a price of EUR 1.50 per litre. If the vehicle is returned with more fuel, EasyRent will not refund any amounts for the excess.
35. The renter is only obliged to hand over the vehicle to a legitimised Easy Rent employee, otherwise he/she is fully liable for the amount of the insurance of the vehicle.
36. The Renter shall exercise due care in the use of the vehicle; shall drive in a fit condition and shall not be under the influence of alcohol, drugs or other substances which restrict or exclude his ability to drive and perform his obligations under Bulgarian law and the General Terms and Conditions, and shall comply with all traffic regulations applicable in the Republic of Bulgaria or other countries where the hired vehicle is used.
37. The Hired Vehicle may be used on the territory of the Republic of Bulgaria and its operation on the territory of other countries requires the prior consent of EasyRent and payment of the relevant fees as provided herein.
38. The vehicle may be driven outside the country only upon prior request by the Renter and approval by EasyRent and subject to the following conditions:
А) the minimum rental period for travel abroad is 7 days;
B) providing information at least 3 days prior to receiving the vehicle regarding the countries to be visited and obtaining express permission;
C) payment of a one-off fee of between EUR 50.00 and EUR 100.00 for one country (depending on the class of car), with an additional charge of EUR 20.00 for each additional country;
D) payment of a triple deposit by credit card depending on the class of vehicle;
E) compulsory payment of the Full Coverage fee.
39. In the event of any attempt to leave the country without the express permission of EasyRent, the Renter shall be liable for a penalty in the amount of the deposit, and EasyRent reserves the right to terminate the contract. In the event of termination, the amount paid for the remainder of the rental period shall also be deemed liquidated damages for the wrongful attempt to leave the country and shall not be refundable.
40. When driving the vehicle outside Bulgaria, the use of vehicle features and systems that require a connection to the internet via a mobile operator's network is prohibited, in the event that the rented vehicle has such or an additional 4G Wi-Fi device is rented. In the event of a breach of this obligation, the Renter shall pay to EasyRent any additional costs for mobile communication services charged by the relevant mobile operator.
41. The Renter is not entitled to a Replacement Vehicle in the event of an accident or damage abroad, even if the Full Cover fee has been paid.
42. The Renter undertakes to return the vehicle within the agreed time and to the office where it was picked-up or to another office in accordance with these Terms and Conditions.
43. In the event of a delay of up to 1 hour in returning the vehicle, the Renter shall be liable for one day's hire.
44. In the event of a delay in returning the vehicle of more than 1 hour, the Renter shall pay a rental charge equal to the rental charge under the individual contract for one day plus 20% thereof. In the event that the return delay lasts more than one day (24 hours), the price under the preceding sentence shall be due for each 24-hour period commenced until the return of the vehicle and the deposit shall be forfeited as a penalty.
45. If the vehicle is not returned within 72 hours, EasyRent will refer the vehicle to the appropriate authorities for a state search. In the event of such a request, the Renter shall pay a fee of EUR 100.00 in addition to the amounts under the preceding provisions.
46. The Renter shall pay the amounts provided for herein, in the Individual Contract or in the Price List (rent, fees, penalties, etc.) upon the occurrence of the relevant grounds for doing so.
47. The Price List is published on EasyRent's website and in a prominent place in the Company's offices. By confirming/signing the General Terms and Conditions or signing the individual contract, the Renter confirms that he/she is familiar with the price list.
48. All sums shall become due (payable) on the day on which the relevant liability is incurred, unless otherwise agreed or provided for in these Terms and Conditions. In the event of default, the penalties and/or damages provided for herein shall be due and payable in accordance with Bulgarian law, without the need to send the Renter a demand for payment.
49. When booking a vehicle through an online platform on EasyRent's website or through an online rent-a-car service platform on which EasyRent offers its services, the Renter shall pay a reservation fee for the rental in the amounts specified on the respective platform.
50. Upon collection of the vehicle, the Renter shall pay a rental fee representing the amount payable for the use of the vehicle during the rental period, a deposit and other amounts for additional services requested by the Renter and not included in the rental fee. If a reservation fee is paid, the same shall be deducted from the rental price.
51. The rental price includes unlimited mileage per day, statutory third-party liability insurance, local vehicle tax and vignette. The rental price does not include fuel and other amounts due in connection with the use of the vehicle, including fines and penalties.
52. Payment of amounts due may be made by credit card or bank transfer. All EasyRent offices have POS terminals for cashless payment. Payment can only be made in cash or by debit card if agreed by EasyRent and if this is permitted by the online booking platforms. Cash payments are also permissible subject to the restrictions stipulated by law.
53. An online booking can be paid by credit/debit card (Visa/MasterCard), PayPaI or by bank transfer.
54. If the Renter wishes to change the vehicle to a lower class than requested, the difference will not be refunded.
55. The deposit shall be paid by credit card (Visa or MasterCard) issued in the Renter's name and shall serve as a guarantee for the performance of the Renter's obligations under the Contract. The amount of the deposit depends on the class of car chosen and varies between EUR 200.00 and EUR 2 000.00. If the Renter does not wish to use the Full Coverage service, the deposit will be triple the amount.
56. In the event of lost keys, lost documents, missing parts, etc., due to the fault of the Renter, the Renter shall due the amount from the deposit or the payment of all costs for their restoration in the event that they exceed the value of the deposit.
57. The deposit shall be released (unblocked) after a full inspection of the condition of the returned vehicle and any undetected violations within 20 working days of the return of the vehicle. In case of loss or if the Renter does not present the authorization receipt, EasyRent is obliged to submit a request to the bank to release the amount, for which the Renter shall pay a fee of 10.00 EUR. The release of the amount shall be carried out in accordance with the terms and conditions of the relevant bank, with a minimum processing and release period of not less than 30 working days.
58. Deposits in cash or by debit card are only allowed in case of payment of the additional Full Coverage fee by the Renter. EasyRent reserves the right to refuse payment of a deposit by cash or debit card and accordingly not to make a vehicle available and this will not be deemed to be a breach on its part.
59. The Deposit is refundable upon return of the Vehicle and in the event that the Renter does not owe any sums, regardless of the reason, to be covered by the amount of the Deposit under these Terms and Conditions.
60. By signing/agreeing to these Terms and Conditions the Renter gives irrevocable and unconditional consent:
A) that the Deposit shall be used to cover the relevant amounts payable by him under these Conditions and the Individual Contract. The Deposit, or an appropriate part thereof, will be forfeited on the day on which the relevant amount becomes due. In the event that the Deposit cannot cover the amount of all sums due, the Renter irrevocably consents to EasyRent withdrawing sums from the credit card provided.
B) EasyRent to withdraw amounts (including direct debit) from the debit/credit card to cover any liabilities incurred during the rental period, notwithstanding that their maturity may occur after the termination of the rental agreement (fines, slips, etc.).
61. Payment of this additional fee confers the following rights in favour of the Renter:
A) refund of the deposit in the event of damage or theft;
B) a replacement vehicle in the event of damage, fire or theft to be provided at an address specified by the Renter;
C) free roadside assistance in the event of damage or fire within the country;
D) 24-hour service and assistance from EasyRent's call centre;
E) exemption from payment of administration fee in case of accident or traffic accident.
62. The Renter may avail of the above rights subject to the following requirements:
A) if, in the event of an accident or traffic accident, the Renter provides EasyRent with a report from the police authorities within one working day of the occurrence;
B) in the event of theft/fire or total damage, the Renter must provide EasyRent with all necessary documents from the traffic police and the vehicle documents are not left in the vehicle compartment;
C) The Renter shall comply with the traffic regulations of the Republic of Bulgaria and of the country in the territory of which he/she is using the vehicle, including but not limited to driving without alcohol, drugs, obeying road conditions and not breaking speed limits;
D) The Lessee shall not provide the vehicle to any person other than those specified in the individual rental agreement.
63. The Full Coverage service does not relieve the Renter of responsibility to indemnify EasyRent for:
A) damage to the interior of the vehicle (upholstery, dashboard, seats, headlining, etc.), also damage to wheels, rims, tires and windows;
B) lost documents, keys, vehicle registration number;
C) missing parts in the vehicle such as CD player, cigarette lighters, rims, GPS navigation device, 4G Wi-Fi internet device, headlights, antenna, etc.;
D) vandalism due to items forgotten or left in the vehicle by the Renter;
E) dead battery and soft or flat tire;
F) where the damage, regardless of its extent, is the result of acts committed by the Renter wilfully or with gross negligence.
64. EasyRent will not provide a replacement vehicle if the Renter has not paid for the Full Coverage service.
65. EasyRent is not liable in case of providing false information by the companies operating the rent-a-car platforms through which EasyRent offers its services.
66. EasyRent shall not be held liable for the (in)action of credit institutions in (un)blocking amounts due, which may lead or have led to the inability to use the blocked amount and/or the credit card, regardless of the duration of the delay.
67. The Renter shall use the rented vehicle for its intended purpose, maintain it in the technical condition in which it was handed over to him, in accordance with the General Terms and Conditions, the individual contract and Bulgarian legislation. In the event of any breach, the Renter shall be liable for the relevant fee and/or penalty provided for in the General Conditions and/or the Individual Contract. In the event that such penalty is not agreed or the penalty cannot cover the full amount of the compensation, the Renter shall be liable to pay the corresponding/full amount of the compensation.
68. EasyRent reserves the right to regain possession of the vehicle without prior notice to the Renter in the event that the vehicle is used in violation of the General Terms and Conditions, the individual contract or Bulgarian law or the law of the country in the territory of which the use of the vehicle is permitted, as well as in cases where the Renter fails to fulfil his/her obligations. In such cases, EasyRent shall not be liable to refund any amounts for the remainder of the rental period.
69. The Renter shall be fully indemnified for any damage caused as a result of: (a) the use of fuel, oil or other consumables of poor quality or incorrectly placed/filled by the Renter; (b) the refuelling of fuel that is not suitable for the type and specifications of the vehicle concerned; (c) the failure to refill water/antifreeze in the vehicle. In the event that such damage occurs which results in the engine becoming blocked, for which the Renter is responsible, and the engine cannot be replaced or replacement would cost more than the insured value of the vehicle, the Renter shall be liable to pay compensation in the amount of the insured value of the vehicle.
70. In the event that an access ticket and/or access card to public car parks at airports is lost, the Renter shall pay a penalty of EUR 50.00.
71. All fines, slips, fees, other penalties and costs received by EasyRent for breaches of the law by the Renter in the use of the hired vehicle will be recovered by or declared in the name of the Renter. An administrative fee of EUR55 shall apply for each individual violation, regardless of its value. Amounts will be charged to the Renter's credit/debit card and EasyRent must notify the Renter in writing or are due within three days of notification.
72. In the event that the use of the vehicle becomes impossible as a result of the (in)action of the Renter, the latter shall owe the rental price under the individual contract for the period during which the use of the vehicle is not possible.
73. Smoking, the use of alcoholic beverages and/or drugs, intoxicants or other prohibited substances, as well as driving during or after the use of alcohol or drugs, intoxicants or other prohibited substances in the rented car are strictly prohibited! In the event of an established violation, the Renter will be liable for a penalty in the amount of the deposit.
74. The transport of illegal resident foreigners as well as pets in the rented vehicle are strictly prohibited. In the event of an established violation, the Renter will owe a penalty in the amount of the deposit.
75. EasyRent shall provide the vehicle washed, and in case of shorter rental than 48 hours, it shall be returned in the same condition. In case of return of a heavily soiled vehicle (upholstery, sand, mud, etc.) the Renter shall pay a fee of EUR 100.00.
76. It is forbidden to use the rented vehicle for competitions, training; for towing another vehicle or trailer; for transporting any cargo, as well as for driving on roads outside the national road network or on roads without a permanent surface, regardless of the purpose. In the event of any breach being found, the Renter will be liable to pay a penalty in the amount of the deposit.
77. In the event of any incident, road traffic accident, any damage to the Vehicle, forcible seizure and detention of the Vehicle by the competent authorities, suspension or cancellation of its registration, theft or any incident involving the Vehicle and all events, which restrict or render impossible the use of the Vehicle for its intended purpose and regardless of the nature or fault of the occurrence, the Renter shall notify EasyRent immediately and shall remain on site, awaiting law enforcement authorities and obtaining a report or other document of the incident. The Renter must report all facts, circumstances and data (names of witnesses, etc.) and fully cooperate with the Police (Traffic Police) to issue a document certifying the event. The Renter undertakes to take all necessary action to salvage, contain and/or mitigate the damage to the Vehicle. The Renter shall, at his own expense and risk, procure any other documents required by EasyRent in connection with the relevant event and submit them to EasyRent within 3 days of the occurrence of the event and shall take all other actions, including, by the 3rd day after the event at the latest, making the Vehicle available for inspection and photographs by EasyRent, at the location specified by EasyRent. The Renter shall assist EasyRent in clarifying the event and in determining the damages suffered by EasyRent, including by responding to inquiries, providing information and documents and providing reasonable assistance in pre-trial and trial proceedings and actions. Submission of improperly completed documents or submissions outside of the specified timeframes shall be deemed a failure to provide documents.
78. In the event that the incident/violation is the fault of the Renter and as a result of the incident/violation the vehicle cannot be used for the purposes of EasyRent's business, the Renter will be liable for a penalty equal to the hire price for the entire period during which the vehicle cannot be used and reimbursement of any additional costs incurred as a result of the incident, accident or violation.
79. The Renter shall not carry out any repairs except with the express consent of EasyRent.
80. In the event of a flat tyre, the Renter shall repair the tyre at his own expense or purchase a set of two new tyres at his own expense.
81. The Renter shall monitor the oil and coolant levels throughout the hire period and, if necessary, purchase the appropriate consumables and top up the vehicle.
82. When leaving the vehicle, the lights, headlights and radio must be switched off and the vehicle documents must not be left inside the vehicle.
83. In the event that the hired vehicle is destroyed or stolen and the Renter fails to comply with any of his obligations under the law or the General Conditions and/or loses the keys to the vehicle and/or any document in his possession which is required for the purpose of making an insurance claim and obtaining an insurance indemnity and the insurer therefore refuses to pay compensation, the Renter shall be liable to pay compensation in the amount of the insured value of the vehicle. The same liability shall apply in the event that the keys and/or documents are left unattended, whether they were inside or outside the vehicle.
84. In the event of new damage(s) (excluding theft/complete destruction), the Renter may only be liable for limited liability (up to a certain amount -excess) if this is stipulated in the relevant rental car service platform on which the Renter has booked his/her vehicle or if EasyRent has agreed to such limited liability.
85. The Renter and the Driver shall be jointly and severally liable for all their obligations provided for in these General Terms and Conditions, in the individual contract, for all damages and for any additional legal or extrajudicial costs (stamp duty, postage, expert fees, lawyers' fees, etc.) that EasyRent will pay to collect the amounts due.
83. In connection with the application of these General Terms and Conditions and the performance of the services provided by EasyRent, as well as in connection with the conclusion and performance of the Individual Contract, EasyRent processes certain categories of personal data of the Renter, as well as possibly of third parties designated by the Renter in connection with the conclusion and performance of the Individual Contract. These categories of personal data are set out in detail in EasyRent's Privacy Policy, available online at https://easyrentbulgaria.bg/informaciq/politika-za-zashtita-na-lichnite-danni.
84. In its capacity as data controller, EasyRent processes the relevant personal data for the purposes, on the legal grounds and within the time limits set out in detail in the Privacy Policy under the preceding point. This Privacy Policy also contains information on the rights that the Renter has in the processing of his personal data by EasyRent.
85. The Renter shall have the right to request and obtain from EasyRent a paper copy of the Privacy Policy referred to in clause 1 above at any time. By accepting these Terms and Conditions, the Renter acknowledges that he/she is aware of the contents of this Policy.
86. The General Terms and Conditions become binding on the Renter upon completion of the online booking in which the Renter has ticked the acceptance box, as well as upon acceptance when booking at an EasyRent office. Acceptance in the latter case shall be evidenced by the signature of the Renter.
87. The parties expressly agree that these General Terms and Conditions, the Rental Agreement, supplements and amendments thereto and any other documents arising out of and/or relating to the General Terms and Conditions and the Rental Agreement may be signed in one of the following ways:
87.1. By handwritten signature on paper.
87.2. By an ordinary electronic signature or an advanced electronic signature within the meaning of Article 3, item 10 and item 11 of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and certification services for electronic transactions in the internal market and repealing Directive 1999/93/EC, in the form of data in electronic form (written signature with a stylus on a tablet or other similar electronic device), which the holder of the electronic signature uses to sign, added to or logically linked to these General Terms and Conditions, the Rental Agreement, amendments and modifications thereto and any other documents which arise from and/or relate to the General Terms and Conditions and the Rental Agreement, where the same are in electronic form.
87.3. The Parties expressly agree that the legal effect of the Parties' ordinary and advanced electronic signatures referred to in Article 87.2 above shall be equivalent to that of their handwritten signatures in accordance with Article 13, Para 4 of the Electronic Documents and Electronic Certification Services Act and Article 25, Para 1 of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and certification services for electronic transactions in the internal market and repealing Directive 1999/93/EC.
In addition, the Parties expressly acknowledge and agree that these General Terms and Conditions, the Rental Agreement, the amendments and supplements thereto and any other documents governing the relationship between the Parties signed by ordinary or advanced electronic signature shall be deemed to be in writing and shall constitute original documents.
The parties undertake not to challenge the admissibility, enforceability or probative value of documents so signed solely on the basis of their electronic form or electronic signature.
87.4. The Rental Agreement and these Terms and Conditions constitute the entire agreement governing the relationship between EasyRent and the Renter in connection with the rental of the Vehicle.
87.5. The Rental Agreement and the General Terms and Conditions shall be governed by the law of the Republic of Bulgaria.
87.6. All disputes concerning the validity and performance of the Rental Contract shall be settled by agreement, failing which by the competent court. In case of disputes, the text of the Rental Contract and the General Terms and Conditions in Bulgarian shall be valid. Documents received by electronic or other communication, including the use of the Internet, shall be admissible as written evidence.
88. EasyRent reserves the right to amend and supplement these Terms and Conditions at any time, and the new Terms and Conditions and the date on which they come into effect will be published on EasyRent's website. EasyRent will notify the Renter of the publication of amended terms and conditions by email or SMS.
89. Correspondence between EasyRent and the Renter will be in writing to the addresses and by the means set out in these terms and conditions and the individual contract. The written form will also be deemed to be complied with if the communication is sent by fax or e-mail. In the event that the relevant message and/or notification/notice is received or entered after 17:00 Bulgarian time, it shall be deemed to have been received on the first following business day. In the event that either party changes any address or means of correspondence, it shall immediately notify the other party. If it fails to do so, the notice shall be deemed to have been duly served if sent by any of the means or to the addresses specified in these Conditions and the individual contract.
90. For any unsettled issues and disputes arising in connection with the conclusion, performance, non-performance, interpretation of the individual contract and the General Terms and Conditions, the legislation of the Republic of Bulgaria shall apply.
91. Disputes shall be referred to the competent Bulgarian court for resolution under the rules of the Civil Procedure Code.
