1. These General Terms and Conditions govern the relations between "EasyRentBulgaria" EOOD, UIC 202163172, hereinafter referred to as "EasyRent", and the Renters arising on the basis of a rental agreement for a vehicle or other items offered by EasyRent.
2. Correspondence with EasyRent is carried out at the following address: Nesebar 8230, Sunny Beach Resort Complex, Karlovo Hotel, ground floor, telephone +359 (0) 889 999 179; email address: [email protected] or through another method indicated on EasyRent’s website: https://easyrentbulgaria.bg/.
3. Throughout these General Terms and Conditions, the following words and expressions, when starting with a capital letter, regardless of whether they are definite or in plural form, shall have the meanings specified in this clause:
A) “General Terms and Conditions” – these General Terms and Conditions for concluding rental agreements for a vehicle (car) or other items offered by EasyRent.
B) “Individual Agreement” means the rental agreement for the vehicle concluded between EasyRent and the Renter. These General Terms and Conditions are an integral part of each individual agreement. In the event of any contradiction between the individual agreement and the General Terms and Conditions, the individual agreement shall prevail.
C) “Renter” – a natural person who wishes to use and/or requests and/or concludes a rental agreement for a vehicle or other items offered by EasyRent.
D) “Driver” – a natural person who will operate the rented vehicle. When the driver is a person different from the Renter, the driver’s relevant details shall be recorded in the individual rental agreement. Only one additional driver may be listed in the agreement. All obligations of the Renter under the General Terms and Conditions and the Individual Agreement shall also be considered obligations of the Driver.
E) “International Driving Permit” – a driving licence that certifies the right to operate a vehicle which, under international agreements entered into force for the Republic of Bulgaria, entitles the Renter to drive the vehicle in the territory of the country and in the territory of the respective state where the use of the rented vehicle is permitted under these General Terms and Conditions.
F) “Car Classes” – categorization of individual cars according to their technical characteristics, class, and standards. The individual car classes are economic, medium, large, estate, premium, minivan, luxury, special, and SUVs, with the classification of specific car makes and models into the respective class indicated on EasyRent’s website or partner platform.
G) “Equivalent Class Vehicle” – a vehicle of the same class, with identical or similar size, the same number of doors and seats.
H) “Rental Price” – the price for renting the respective vehicle for a period of 24 hours, as stated in EasyRent’s Price List or published on EasyRent’s website, or stated in the rental agreement;
I) “Fee” – an additional amount, separate from the rental price, payable by the Client for the provision of an additional service or for carrying out additional actions by EasyRent in accordance with the General Terms and Conditions, the individual agreement and the Price List.
J) “Full Coverage Fee” – an amount determined depending on the class of the vehicle, according to EasyRent’s Price List, through the payment of which the Renter benefits from the additional services provided under these General Terms and Conditions.
K) “Price List” — a list of additional services/extras provided by EasyRent, specifying their prices/fees.
4. The Renter must possess and present to EasyRent a valid driving licence for the respective vehicle category, valid for a period not shorter than one month after the end of the rental period, as well as a functioning credit card — with an available (unused) limit not less than the amount of the deposit, and with validity not earlier than six months after the end of the rental period. Drivers who are citizens of a country outside the European Union must present an International Driving Permit.
5. The Renter is required to present identification documents (identity card or passport) with a minimum validity period not shorter than one month after the end of the vehicle rental period.
6. The minimum age for renting a vehicle without additional charges is 25 years for economic, medium, large, estate and minivan classes, and 30 years for luxury, premium, special class vehicles and SUVs.
7. Clients aged between 18 and 25 and over 65, and with driving experience of less than 3 years, shall pay additionally:
(a) a “Young Driver” fee of EUR 10.00 per rental day;
(b) a “Full Coverage” fee, determined according to the type of vehicle;
(c) a deposit in triple amount, determined according to the type of vehicle.
8. The Renter must have at least 6 months of driving experience when renting vehicles of the “economic, medium, large, estate and minivan” classes, and 5 years for luxury, premium, special class vehicles and SUVs.
9. EasyRent reserves the right to refuse a reservation or the provision of the vehicle if any of the documents presented by the Renter do not meet the requirements of the General Terms and Conditions or are damaged/invalid.
10. The Renter may reserve a vehicle through the online platform on the EasyRent website; through an online car rental platform on which EasyRent offers its services (partners); by phone request; or at the company’s office. In the case of an online reservation, it shall be considered confirmed after receiving an electronic message confirming the payment or upon the occurrence of the conditions for confirmation according to the policy of the respective platform.
11. In the case of a reservation at an EasyRent office or upon receiving the vehicle under an online reservation, the Renter must conclude an individual rental agreement, which determines the conditions for renting the vehicle — type of car, license plate number, rental period, rental price, condition of the vehicle and other matters. The General Terms and Conditions are an integral part of the individual agreement.
12. The minimum rental period for a vehicle is 24 hours. The vehicle may be provided for a shorter period only with the prior approval of EasyRent, in which case the Renter shall owe a rental price equal to the price for the minimum period. The same rule applies when extending the rental period by only a few hours.
13. The extension of the rental period may be made through the online platform on the company’s website or at an EasyRent office, no later than one day before the expiration of the rental period under the individual agreement. The extension may be executed by noting it in the individual agreement, by signing an annex, or by concluding a new agreement. The price for the new rental period depends on the length of the extension according to the current Price List on the payment date, and the “Full Coverage” fee is always charged.
14. When the extension of the rental period includes using the vehicle in another country, a fee of EUR 20.00 is charged for extending the validity of the authorization for driving abroad for up to 7 days. If the rental period is extended by more than 7 days, the Renter shall pay all fees and expenses for issuing a new authorization for driving abroad, as well as a new one-time border crossing fee in accordance with the Price List.
15. If EasyRent agrees to extend the rental period, the Renter must pay the new rental price and all additional fees on the same day. The deposit cannot be used to cover the rental price for the extended period, as throughout the term of the rental agreement the deposit must remain in full amount. After the payment is made, the required documents are left available in the respective office. The Renter is obligated to visit the office and receive/sign the respective documents. EasyRent bears no responsibility for any consequences if the Renter fails to collect the new documents.
16. EasyRent reserves the right to refuse an extension of the rental period, in which case the Renter must return the vehicle in accordance with the agreement and the General Terms and Conditions.
17. A confirmed and paid reservation may be changed/cancelled free of charge up to 48 hours before the scheduled pickup time of the vehicle.
When the reservation is made through the online platform on the EasyRent website, the reservation fee is refunded to the Renter within up to 20 working days.
17.1. In the event of cancellation between the 48th and the 24th hour before the scheduled pickup time, when the reservation is made through the online platform on the EasyRent website, the prepaid fee may be added to the Renter’s wallet in their website profile and used for a future reservation without any time limitation.
For the period during which the amount remains in the Renter’s virtual wallet, EasyRent does not owe interest, compensation, or any other reimbursement.
Amounts in the wallet are not subject to cash-out.
18. In case of cancellation of a reservation up to 24 hours before the scheduled pickup time, the prepaid reservation amount is non-refundable.
18.1. If the Client does not show up within 1 hour after the scheduled pickup time, without prior notice of delay, the reservation is considered cancelled, and all prepaid amounts are NOT refunded.
19. If the reservation is made through another online car rental platform on which EasyRent offers its services, the cancellation and refund of the reservation fee is carried out in accordance with the General Terms/Policy of the respective platform and not by EasyRent.
20. EasyRent reserves the right to refuse a confirmed reservation if it is unable to provide the requested vehicle or another from an equivalent class, in which case the amount paid by the Renter shall be fully refunded. In this case, EasyRent does not owe any compensation to the Renter.
21. In addition to the cases provided in these conditions, EasyRent reserves the right to refuse to provide a vehicle in the event of improper and/or inappropriate behavior of the Renter or when there is a justified reason to believe that the Renter will not be able to fulfill the agreement. In this case, the reservation fee is refunded to the Renter unless otherwise stated in the General Terms and Conditions.
22. The vehicle is handed over in excellent technical condition, together with the equipment required by law or additionally paid for by the Renter. The condition of the vehicle and its equipment is established/described in the individual agreement upon receipt of the vehicle, in the mandatory presence of the Renter. By signing the agreement, the Renter agrees with all damages noted in their presence at the time of receiving the vehicle.
23. The EasyRent offices at Sofia Airport, Varna Airport, and Burgas Airport operate 24/7. Vehicles may be picked up or returned at these locations at any time without any additional fee, provided this occurs on non-holiday days and the vehicle is returned to the same office from which it was collected.
23.1. Public Holidays:
For reservations handled during Easter and the Christmas–New Year holidays (24–26 December, 31 December and 1 January), an additional fee of €25 applies. This fee covers the cost of providing staff for holiday overtime during vehicle pick-up or drop-off.
24. The working hours of the other EasyRent offices are listed on the company website and displayed onsite in the respective offices. Vehicles may be picked up/returned within the working hours of these offices. If the Renter requests pickup or return of the vehicle outside working hours, an additional fee of EUR 20.00 shall apply.
25. EasyRent does not have offices outside the territory of the country and does not use offices of other companies providing the same services.
26. EasyRent reserves the right to provide a different make and model of vehicle from the one originally reserved, but of an equivalent class. If the reserved vehicle is not available at the time of pickup and no other equivalent vehicle is available, EasyRent may offer the Renter a vehicle from a higher class. If the Renter does not agree to the replacement under these terms, without any extra charge requested for the class difference, the prepaid amount is not refunded.
27. If the “Full Coverage” fee has been paid with the rental, EasyRent may provide a replacement vehicle in the event of a breakdown due to a technical defect or wear of any part. Replacement is performed at the nearest company office. If the vehicle cannot be moved on its own, replacement is carried out at the location of the disabled vehicle, and all costs are borne by EasyRent. When the breakdown is the result of the Renter’s fault (actions or omissions), the Renter must pay all costs related to the replacement as well as the repair of the vehicle.
28. The paid reservation fee is non-refundable, and the reserved vehicle is released when:
A) the Renter does not appear at the designated pickup location within one hour after the scheduled pickup time, without notifying EasyRent in advance or without providing a flight number;
B) the Renter has not cancelled the reservation within the applicable time limits under the General Terms and Conditions;
C) the Renter does not provide any of the required documents under the General Terms and Conditions, or any of the documents is damaged or invalid;
D) the Renter refuses to pay the rental price and/or the deposit and/or any additional requested services upon signing the agreement or within the required time under the General Terms;
E) the Renter does not possess a valid credit card in their name with sufficient available (unused) credit limit to cover the rental price and/or deposit;
F) in other cases provided for in the General Terms and Conditions.
29. If the vehicle is returned earlier than the date specified in the contract at the Renter’s request, EasyRent does not refund the amount for the remaining rental period.
30. If the Renter is provided with tickets and/or access cards to airport parking areas, they may be used solely for exiting the parking area upon receiving the vehicle. Parking for longer periods than necessary for exiting the area is prohibited. If the Renter fails to comply and EasyRent is required to pay parking fees or penalties, the Renter shall compensate EasyRent for the full amount paid.
31. The vehicle must be returned to the same EasyRent office where it was picked up. Returning it to another office is possible only upon request by the Renter, made no later than 24 hours before the return date, subject to EasyRent approval and payment of a one-way rental fee according to the Price List. EasyRent reserves the right to refuse return of the vehicle to a different office.
32. If the vehicle is to be returned to a parking area, it must be parked only in spots designated for EasyRent or indicated by an EasyRent employee.
33. The Renter must return the vehicle in the same condition and with the same equipment as received. If discrepancies are found, the Renter must compensate EasyRent for all damages caused. If the Renter refuses to sign the discrepancy report upon return, this is certified by the signature of one witness, and the findings are binding on the Renter. The same applies if the Renter is absent or refuses to be present unless there is a justified reason.
34. The Renter must return the vehicle with the same fuel level as when received. If the vehicle is returned with less fuel, the Renter owes a service fee of EUR 20.00 and pays the missing fuel at a rate of EUR 2.00 per liter. If returned with more fuel, EasyRent does not refund the difference.
35. The Renter must hand over the vehicle only to an authorized EasyRent employee; otherwise, the Renter bears full responsibility equal to the insurance value of the vehicle.
36. The Renter is obliged to exercise the care of a prudent owner when using the vehicle; to drive in a fit condition to do so and not to be under the influence of alcohol, narcotic substances or other substances which limit or exclude their ability to drive and to fulfil their obligations under Bulgarian law and the General Terms and Conditions, as well as to comply with all traffic rules applicable in the Republic of Bulgaria or other countries where the rented vehicle is used.
37. The rented vehicle may be used on the territory of the Republic of Bulgaria, and for driving it on the territory of other countries the prior consent of EasyRent and payment of the respective fees is required, as provided herein.
38. The vehicle may be driven outside the country only after a prior request by the Renter and approval by EasyRent and subject to simultaneous compliance with the following conditions:
A) the minimum rental period for travelling abroad is 7 days;
B) provision of information at least 3 days before receiving the vehicle regarding the countries the Renter wishes to visit, and obtaining explicit permission;
C) payment of a one-time fee between EUR 70.00 and EUR 100.00 per country (depending on the vehicle class), and an additional EUR 20.00 for each subsequent country;
D) payment of a deposit in triple amount by credit card depending on the vehicle class;
E) mandatory payment of the “Full Coverage” fee.
39. In the event of any attempt to leave the country without the explicit permission of EasyRent, the Renter owes a penalty in the amount of the deposit, and EasyRent reserves the right to terminate the agreement. In the event of termination, the amount paid for the remaining rental period is also considered a penalty for the unlawful attempt to leave the country and is non-refundable.
40. When driving the vehicle outside Bulgaria, it is forbidden to use any functions and systems of the vehicle requiring an Internet connection via a mobile operator’s network, if the rented vehicle is equipped with such or if an additional 4G Wi-Fi device has been rented. In case of violation of this obligation, the Renter must reimburse EasyRent for all additional mobile communication costs charged by the respective mobile operator.
41. Smoking, consumption of alcoholic beverages and/or narcotic, intoxicating or other prohibited substances, as well as driving during or after the use of alcohol or narcotic, intoxicating or other prohibited substances, as well as the transportation of pets in the rented vehicle, are strictly prohibited. In the event of a violation, the Client will owe a penalty in the amount of the deposit.
42. EasyRent provides the vehicle washed, and for rentals shorter than 48 hours it must be returned in the same condition. If the vehicle is returned heavily soiled (upholstery, sand, mud, etc.), the Client shall pay a fee of EUR 100.00.
43. It is forbidden to use the rented vehicle for participation in competitions or training; for towing another vehicle or trailer; for transporting any kind of cargo; as well as for driving on roads outside the national road network or on roads without a permanent surface, regardless of the purpose. In case of a violation, the Client will owe a penalty in the amount of the deposit.
44. In the event of an incident, traffic accident, any damage to the Vehicle, forced seizure and retention of the Vehicle by the competent authorities, immobilisation or deregistration, theft or any incident relating to the Vehicle and any events that limit or make impossible the use of the Vehicle for its intended purpose, regardless of the nature of the event and of fault, the Renter is obliged to notify EasyRent immediately and to remain at the scene, waiting for the law enforcement authorities and obtaining a report or other document regarding the incident.
The Renter must report all facts, circumstances and data (names of witnesses, etc.) and provide full assistance to the Police/Traffic Police for issuing a document certifying the event.
44.1. The Renter undertakes to take all necessary actions to save, limit and/or reduce the damages to the Vehicle.
44.2. The Renter is obliged, at their own expense and responsibility, to obtain all other documents requested by the Lessor in connection with the event, and to provide them to the Lessor within 3 days of the occurrence of the event, as well as to carry out all other actions, including, at the latest by the 3rd day after the event, to present the Vehicle for inspection and photos by the Lessor at the location indicated by the Lessor.
44.3. The Renter is obliged to assist the Lessor in clarifying the event and in determining the damages suffered by the Lessor, including by responding to enquiries, providing information and documents, and giving reasonable assistance in pre-trial and court proceedings. Providing incorrectly completed documents or providing them outside the specified deadlines is considered as non-provision of documents.
44.4. If the Renter is at fault for the incident/violation and, as a result, the vehicle cannot be used for EasyRent’s business activities, the Renter will owe a penalty equal to the rental price for the entire period during which the vehicle cannot be used, as well as reimbursement of all additional expenses arising from the incident, accident or violation.
45. The Client is not entitled to carry out repairs, except with the express consent of EasyRent.
46. In the event of a flat tyre, the Client is obliged to repair it at their own expense or to purchase a set of two new tyres at their own expense.
47. The Client is obliged to monitor the oil and coolant levels throughout the rental period and, if necessary, to purchase the respective consumables and top them up in the vehicle.
48. When leaving the vehicle, the lights, headlights and radio must be switched off, and the vehicle documents must not be left inside the vehicle
49. The Renter undertakes to return the vehicle within the agreed term and to the office where it was received, or to another office in accordance with these General Terms and Conditions.
50. In case of a delay in returning the vehicle of up to 1 hour, the Renter owes a rental price for one day.
51. In case of a delay in returning the vehicle of more than 1 hour, the Renter owes a rental price equal to the daily rate under the individual agreement plus 20% of that amount. If the delay continues for more than one day (24 hours), the price under the previous sentence is owed for each started 24-hour period until the vehicle is returned, and the deposit is retained as a penalty.
52. If the vehicle is not returned within 72 hours, EasyRent will notify the relevant authorities to declare the vehicle wanted by the police. In the event such a request is filed, the Renter owes a fee of EUR 100.00 in addition to the amounts under the previous provisions.
53. The Renter is obliged to pay the amounts provided herein, in the individual agreement or in the Price List (rental price, fees, penalties and others) when the respective grounds arise.
54. The Price List is published on the EasyRent website as well as displayed in a visible place in the company's offices. By confirming/signing the General Terms and Conditions or by signing the individual agreement, the Renter confirms that they are familiar with the Price List.
55. All amounts become due (payable) on the day on which the respective obligation arises, unless otherwise agreed or provided in these General Terms and Conditions. In case of delay, the penalties and/or compensations provided herein and those due under Bulgarian law shall apply, without the need to send a notice to the Renter.
56. When reserving a vehicle through the online platform on the EasyRent website or through an online car rental platform on which EasyRent offers its services, the Renter pays a reservation fee in the amounts determined on the respective platform.
57. Upon receiving the vehicle, the Renter must pay the rental price, representing the amount due for the use of the vehicle during the rental period, the deposit, and other amounts for additional services requested by the Renter and not included in the rental price. If a reservation fee has been paid, it is deducted from the rental price.
58. The rental price includes unlimited mileage per day, compulsory third-party liability insurance, local vehicle tax, and vignette. The rental price does not include fuel and other amounts owed in relation to the use of the vehicle, including any fines and penalties.
59. Payment of the due amounts may be made by credit card or bank transfer. All EasyRent offices have POS terminals for cashless payments. Payment may be made in cash or by debit card only with the consent of EasyRent and if allowed by the online reservation platforms. Cash payments are permitted only in compliance with the restrictions set by law.
60. An online reservation may be paid by credit/debit card (Visa/MasterCard), PayPal or bank transfer.
61. If the vehicle is changed at the Renter’s request to a lower class than the reserved one, the difference in the amount is not refunded.
62. The deposit is paid by credit card (Visa or MasterCard) with an EMBOSSED NUMBER, issued in the name of the RENTER and valid for at least ONE YEAR after the end date of the contract (vehicle return)!
It serves as a guarantee for the fulfilment of their obligations under the agreement. The deposit amount depends on the selected vehicle class and ranges between EUR 200.00 and EUR 2,000.00. If the Renter does not wish to use the “Full Coverage” service, the deposit is in triple amount.
63. In case of a lost key, lost documents, missing parts, etc., due to the Renter’s fault, the Renter owes the amount of the deposit or the full cost of their replacement if it exceeds the deposit amount.
64. The deposit is released (unblocked) after a full inspection of the returned vehicle and confirmation that no violations have been found, within 20 working days from the return of the vehicle. In case of loss or if the Renter does not provide the authorization slip, EasyRent undertakes to submit a request to the bank for releasing the amount, for which the Renter owes a fee of EUR 10.00. The release of the amount is carried out in accordance with the conditions and deadlines of the respective bank, with a minimum processing period of not less than 30 working days.
65. Deposits in cash or by debit card are allowed only if the Renter has paid the additional “Full Coverage” fee. EasyRent reserves the right to refuse acceptance of a cash or debit card deposit and accordingly not to provide a vehicle, without this being considered a breach on its part.
66. The deposit is refundable upon return of the vehicle, provided that the Renter does not owe any amounts, regardless of their grounds, which must be covered by the deposit in accordance with these General Terms and Conditions.
67. By signing/agreeing to these General Terms and Conditions, the Renter gives irrevocable and unconditional consent:
A) for the deposit to be used to cover the amounts owed by them under these terms and the Individual Agreement. The deposit or a relevant part of it will be retained on the day the respective amount becomes due. If the deposit cannot cover all due amounts, the Renter gives irrevocable consent to EasyRent to withdraw funds from the provided credit card.
B) for EasyRent to withdraw amounts (including direct debit) from the debit/credit card to cover any liabilities arising during the rental period, even if their due date occurs after the termination of the rental agreement (fines, tickets, etc.).
68. Transactions are carried out through the MasterCard Identity Check and VISA Secure security programs.
69. For security reasons, the maximum amount for card payments is BGN 10,000.
70. We do not store data of bank cards used for payments through the website.
71. If a refund of an amount paid by bank card is required, the amount will be refunded to the card used for the payment.
72. Payment of this additional fee grants the following rights to the Renter:
A) refund of the deposit in case of damage or theft;
B) a replacement vehicle in case of damage, fire or theft, delivered to an address specified by the Renter;
C) free roadside assistance in case of damage or fire on the territory of the country;
D) 24/7 support and assistance from EasyRent’s call center;
E) exemption from paying an administrative fee in case of an incident or traffic accident.
73. The Renter may benefit from the above rights only if the following requirements are met:
A) in case of an incident or traffic accident, the Renter provides EasyRent with a police report within one working day of its occurrence;
B) in case of theft/fire or total damage, the Renter must provide EasyRent with all necessary documents issued by the Traffic Police and ensure that the vehicle documents were not left inside the vehicle;
C) the Renter must comply with the traffic regulations of the Republic of Bulgaria and of the country in which the vehicle is used, including but not limited to driving without alcohol or drugs, adjusting to road conditions and not violating speed limits;
D) the Renter must not allow any person other than those listed in the individual rental agreement to drive the vehicle.
74. The “Full Coverage” service does not release the Renter from liability for compensating EasyRent for:
A) damage to the interior of the vehicle (upholstery, dashboard, seats, lining, etc.), as well as damage to wheels, rims, tires and windows;
B) lost documents, keys, vehicle registration plate;
C) missing parts from the vehicle such as CD player, lighters, rims, GPS navigation device, 4G Wi-Fi device, headlights, antenna, etc.;
D) vandalism resulting from forgotten or left belongings of the Renter inside the vehicle;
E) dead battery and soft or flat tire;
F) any damages, regardless of their extent, caused intentionally or through gross negligence by the Renter.
G) EasyRent does not provide a replacement vehicle if the Renter has not paid for the “Full Coverage” service.
75. EasyRent is not liable in case of false or incorrect information provided by the companies operating the car rental platforms through which EasyRent offers its services.
76. EasyRent is not liable for the (in)actions of credit institutions regarding the (un)blocking of the due amounts, which may result in or have resulted in the impossibility of using the blocked amount and/or the credit card, regardless of the duration of the delay.
77. The Renter is obliged to use the rented vehicle according to its intended purpose and to maintain it in the technical condition in which it was delivered, in accordance with the General Terms and Conditions, the individual agreement and Bulgarian law. In case of any violation, the Renter owes the respective fee and/or penalty provided in the General Terms and Conditions and/or the Individual Agreement. If no such penalty is agreed upon or if the penalty cannot cover the full amount of the compensation, the Renter owes payment of the respective/full compensation.
78. EasyRent reserves the right to reclaim possession/control of the vehicle without prior notice to the Renter if the vehicle is used in violation of the General Terms and Conditions, the individual agreement, Bulgarian legislation or the legislation of the country in which the vehicle is permitted for use, as well as when the Renter fails to fulfil their obligations. In such cases EasyRent does not owe any refund for the remaining rental period.
79. The Renter owes full compensation for damages resulting from:
80. In case an airport parking access ticket and/or access card is lost, the Renter owes a penalty of EUR 50.00.
81. All fines, tickets, fees, other sanctions and expenses received by EasyRent due to violations of the law committed by the Renter while using the rented vehicle shall be reimbursed by the Renter or declared in their name. An administrative fee of EUR 55 applies for each violation, regardless of its amount. The sums shall be charged from the Renter’s credit/debit card, and EasyRent must notify the Renter in writing, or the sums must be paid within three days of the notification.
82. If the use of the vehicle becomes impossible as a result of the Renter’s (in)actions, the Renter owes the rental price under the individual agreement for the period during which the use of the vehicle is not possible.
83. Transporting undocumented/illegal migrants as well as pets in the rented vehicle is strictly prohibited. In case of violation, the Renter owes a penalty equal to the deposit.
84. If the rented vehicle is destroyed or stolen and the Renter fails to fulfil any obligation under the law or the General Terms and Conditions and/or loses the car keys and/or a document in their possession necessary for filing an insurance claim, and due to this the insurer refuses to pay compensation, the Renter owes compensation equal to the insurance value of the vehicle. The same liability applies if the keys and/or documents are left unattended, whether inside or outside the vehicle.
85. In the event of new damage(s) (excluding theft/total loss), the Renter may bear limited liability (up to an excess amount) only if this is provided for on the respective car rental platform where the vehicle was reserved, or if EasyRent has agreed to such limited liability.
86. The Renter and the Driver are jointly and severally liable for all their obligations under these General Terms and Conditions, the individual agreement, for all damage compensations, and for all additional judicial or extrajudicial expenses (state fees, postal fees, expert reports, legal fees, etc.) that EasyRent will incur for collecting the due amounts.
87. In connection with the application of these General Terms and Conditions and the performance of the services provided by EasyRent, as well as in relation to the conclusion and execution of the Individual Agreement, EasyRent processes certain categories of personal data of the Renter, as well as possibly of third parties indicated by the Renter in connection with the conclusion and execution of the Individual Agreement. These categories of personal data are detailed in EasyRent’s Privacy Policy, available online at https://easyrentbulgaria.bg/informaciq/politika-za-zashtita-na-lichnite-danni.
88. In its capacity as a personal data controller, EasyRent processes the respective personal data for purposes, on legal grounds and within retention periods detailed in the Privacy Policy referenced in the previous clause. This Privacy Policy also contains information about the rights that the Renter has in relation to the processing of their personal data by EasyRent.
89. The Renter has the right at any time to request and receive from EasyRent a paper copy of the Privacy Policy referred to in item 1 above. By accepting these General Terms and Conditions, the Renter confirms that they are familiar with the content of this Policy.
90. The General Terms and Conditions become binding for the Renter after completing the online reservation, during which they have checked the box confirming acceptance, as well as upon accepting them when making a reservation at an EasyRent office. Acceptance in the latter case is certified by the Renter’s signature.
91. The Parties expressly agree that these General Terms and Conditions, the Rental Agreement, any amendments and supplements thereto, and any other documents arising from and/or related to the General Terms and Conditions and the Rental Agreement, may be signed in one of the following ways:
91.1. With a handwritten signature on paper.
91.2. With a simple electronic signature or an advanced electronic signature within the meaning of Art. 3, items 10 and 11 of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market, in the form of data in electronic form (a stylus-written signature on a tablet or similar electronic device), used by the holder to sign, added or logically linked to these General Terms and Conditions, the Rental Agreement, amendments and supplements thereto, and any related documents, when they are in electronic form.
91.3. The Parties expressly agree that the legal effect of the simple and advanced electronic signatures under Art. 89.2 above shall be equivalent to that of handwritten signatures in accordance with Art. 13, para. 4 of the Electronic Document and Electronic Trust Services Act and Art. 25, para. 1 of Regulation (EU) No 910/2014.
91.4. Additionally, the Parties expressly confirm and agree that these General Terms and Conditions, the Rental Agreement, amendments and supplements thereto, and any other documents governing the relations between the Parties, signed with a simple or advanced electronic signature, shall be considered to be made in writing and shall constitute original documents.
91.5. The Parties undertake not to dispute the admissibility, enforceability or evidentiary value of documents signed in such manner solely on the grounds of their electronic form or electronic signing.
91.6. The Rental Agreement and these General Terms and Conditions constitute the entire agreement governing the relations between the Lessor and the Renter in relation to the rental of the Vehicle.
92. The Rental Agreement and the General Terms and Conditions are governed by the law of the Republic of Bulgaria.
93. All disputes regarding the validity and performance of the Rental Agreement shall be resolved amicably, and if this is not possible — by the competent court. In case of disputes, the Bulgarian version of the Rental Agreement and the General Terms and Conditions shall prevail. Documents received through electronic or other communication, including via the Internet, shall be admitted as written evidence.
94. EasyRent reserves the right to amend and supplement these General Terms and Conditions at any time, with the new General Terms and Conditions and their effective date being published on the EasyRent website. EasyRent shall notify the Renter of the publication of amended terms by email or SMS.
95. Correspondence between EasyRent and the Renter shall be carried out in writing at the addresses and by the means specified in these terms and the individual agreement. Written form shall be deemed complied with if the message is sent by fax or email. If the respective message and/or notice is received after 17:00 Bulgarian time, it shall be considered received on the next working day. If either Party changes its address or means of correspondence, it must notify the other Party immediately. Failure to do so will result in messages being deemed duly delivered if sent by any of the means or to the addresses specified in these terms and the individual agreement.
96. For any matters or disputes not regulated herein and arising in relation to the conclusion, performance, non-performance or interpretation of the individual agreement and the General Terms and Conditions, the legislation of the Republic of Bulgaria shall apply.
97. Disputes shall be referred to the competent Bulgarian court under the rules of the Civil Procedure Code.
